The First Amendment does not guarantee that it provides freedom of religion but that it establish no law pertaining to religion and the exercise thereof. Likewise, the Constitution does not guarantee these freedoms in the sense of defending them by positive activity: freedom of speech and of the press, but only in so far as it does not infringe upon them by letter and by law.
